Singapore based cable importer Midland Metals Overseas PTE Limited (Midlands) has had legal proceedings it brought against by the Australian Cablemakers Association Limited dismissed by the Supreme Court of New South Wales.

Midlands’ subsequent appeal to the Court of Appeal has also been dismissed.

Midlands has been ordered to pay the ACA’s legal costs.

Both the Supreme Court and the Court of Appeal totally rejected a claim by Midlands that the ACA had engaged in conduct in breach of the Australian Consumer Law. Among other things, the Court rejected claims by Midlands that letters sent by the ACA to various Government Ministers in April 2016 were likely to lead those Ministers into error.
